General Information: The Winner’s Club Sweepstakes (the “Sweepstakes”) was created to give back to the members of the Owner-Operators & Small Carriers Alliance, hereinafter referred to as “OOSCA”. OOSCA members are automatically entered into the Sweepstakes, and the random winner is announced on the last day of each month. The monthly prize is either One Thousand Dollars ($1,000) or equal to the number of members we have at the beginning of each month, whichever is greater.

Eligibility: Winner’s Club Sweepstakes (hereinafter referred to as the “Sweepstakes”) is open only to legal residents of United States, who are at least eighteen (18) years of age at the time of entry. Void in all other jurisdictions and where prohibited by law. Employees, contractors, directors, agents and officers of OOSCA and its affiliates, sales representatives, consultants, sub-contractors, suppliers, legal counsel, marketing agencies and all other service agencies involved with the Sweepstakes, and members of their immediate families (spouse, parents, children, siblings and each of their respective spouses) and household members of each such employee are not eligible to participate. By participating, entrants agree to these Official Rules and the decisions of OOSCA, which are final and binding in all matters relating to this Sweepstakes. Winning a prize (as defined below) is contingent upon fulfilling all requirements set forth herein.

Timing: Each Sweepstakes period begins on the first of each month at 8 a.m. central time and ends on the last day of each month at 12 p.m. central time (the “Sweepstakes Period”) and repeats every month at OOSCA’s discretion in accordance with all applicable federal, state and local laws and regulations.

Entry: OOSCA members are automatically entered into each months’ Sweepstakes. No purchase is necessary to enter or win. Individuals wanting to enter the Sweepstakes for free may do so by emailing us on the first day of each month at info@oosca.org, after which they’ll get 1 entry into the Sweepstakes. Our Alliance members will receive an additional entry just for being our members, bringing their monthly entries to two (2). Our upgraded Alliance & ClubHouse members will receive an additional entry above the Alliance members just for being our upgraded members, bringing their monthly entries to a total of three (3). Our upgraded Alliance & ClubHouse+ members will receive an additional entry above the Alliance & ClubHouse members just for being our upgraded members, bringing their monthly entries to a total of four (4). And finally, our Ultimate members will receive an additional entry above the Alliance & ClubHouse+ membership for being our most valued members, bringing their monthly entries to six (6). All entries will be reviewed for compliance with these Official Rules. Unpaid membership dues at the beginning of a Sweepstakes period will cause that members’ entries for that Sweepstakes period to be disqualified.

Publicity: The more members we have, the higher the monthly prize! During each Sweepstakes Period, you may spread the word on your social media and ask everyone you know to do the same. You may do this by going to facebook.com/Groups/TruckerUnited1 and Join the group, comment about how much you love the Truckers’ Fortune Sweepstakes and share on your profile publicly (your posts set to “public”) and across the rest of your social media. If you do not have Facebook, you can create a free account by downloading the mobile app in the App Store (Apple) or the Play Store (Android) or visiting Facebook.com on your computer. Entries must not infringe any third-party’s rights; must be suitable for publication (i.e., may not be obscene or indecent); must not contain obscene or pornographic material; may not contain defamatory statements; may not invade privacy, publicity or other rights of any person, firm or entity; may not in any other way violate applicable laws and regulations; may not contain any reference to any third party trademarks, names or third party logos; and may not infringe any copyrighted works owned by third parties. If your entry includes any person other than the entrant, the entrant must receive express consent from that individual to include them in your post for the purpose of this Sweepstakes, and entrant agrees to provide any necessary documentation evidencing such consent if requested by the OOSCA. Acceptance of the prize constitutes permission to the OOSCA and its agents to use the winner’s name and/or likenesses, prize information, photograph, voice and comments for purposes of advertising and trade without further notice, permission or compensation, unless prohibited by law.

Limit: Entries received before or after the Sweepstakes Period will not be accepted or be eligible to win the prize. Multiple entrants are not permitted to share an email address or Facebook account. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email accounts, identities, registrations and logins, or any other methods will void all of that entrant’s entries and that entrant may be disqualified from the entire Sweepstakes. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the email account used to register the Facebook account will be deemed to be the registrant or player. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. The potential winner may be required to show proof of being the authorized account holder of the account associated with the winning entry.

Winner Selection: OOSCA will randomly select one (1) potential winner from among all eligible entries received during each Sweepstakes Period. An entrant is not a winner of any prize, even if the sweepstakes should so indicate, unless and until entrant’s eligibility and compliance with the Official Rules have been verified and entrant has been notified that verification is complete. The potential winner will be notified within twenty-four (24) hours by a phone call, text message or email. The potential winner will be subject to verification of eligibility, and may be required to sign and return an Affidavit of Eligibility/Release of Liability/Prize Acceptance Form (“Release”) within twenty-four (24) hours of the date notice or attempted notice is sent in order to claim the prize. If a potential winner cannot be reached (regardless of reason) within seventy-two (72) hours, there is a return of any prize notification as undeliverable, or fails to provide the Release within the requested time period (if applicable), or is disqualified for any other reason, the potential winner forfeits the prize and OOSCA will award the prize to an alternate winner selected by a random drawing from among all remaining eligible entries received. Only one (1) alternate drawing will be held at OOSCA’s discretion, after which the prize will remain un-awarded. Upon disqualification, no further compensation will be given. Failure to comply with any term or condition of these Official Rules may result in disqualification at OOSCA’s sole discretion. Odds of winning the prize will depend upon the total number of eligible entries received.

Disqualification: OOSCA may disqualify any winner (and cause any applicable prizes to be forfeited) due to any of the following: (a) the winner fails to comply with any of the terms, conditions, restrictions, or limitations of these Official Rules (as determined by OOSCA in OOSCA’s sole discretion); (b) the winner fails to respond to the winner notification or any other notice (in each case as set forth in such notice) within seventy two (72) hours after its transmission; (c) the winner fails to complete, sign, have notarized, and postmark an Affidavit of Eligibility and Liability and Publicity Release (where not prohibited by law and if requested by OOSCA) within seven (7) business days of its delivery to the winner; or (d) the inability of OOSCA to contact a potential winner within seven (7) business days of the winner announcement, or (e) the return of any winner notification, notice, or prize as undeliverable.

Prize: The cash prize will be equal to either One Thousand Dollars ($1,000) or the number of members OOSCA has at the beginning of each Sweepstakes period (each month), whichever is greater. For example, if OOSCA has 10,000 members, the monthly prize will be $10,000. The prize will be transferred electronically within twenty-four (24) hours of contacting and verifying the winner, getting all legalities in order and making arrangements. The prize is limited to just the cash prize and no other expenses, including but not limited to travel, personal expenses, incidental expenses, internet, telephone calls, messages, bank service charges, fees and/or taxes. No other expenses are included in the prize and are solely the winner’s responsibility. Any and all taxes on a prize are the sole responsibility of prize winner, including, but not limited to any federal, state, and/or local tax.  The cash value of each prize awarded to a winner may be reported for tax purposes as required by law, and as a condition of winning and accepting any prize, such winner must provide any additional information requested by OOSCA necessary and sufficient for OOSCA to comply with applicable tax reporting obligations or winner shall forfeit the prize.

Prize Restrictions: No substitution or exchange of prize is permitted, except by OOSCA as set forth below. Additional terms and conditions may apply to prize. Games are subject to, among other things, delay, postponement, rescheduling and cancellation by game coordinators. All federal, state and local taxes are the sole responsibility of winners. Prize consists of only those items specifically stated as part of the prize. All expenses and costs associated with the acceptance or use of the prize that are not expressly specified in these Official Rules as being part of the prize are the sole responsibility of the winner. OOSCA will not replace any lost or stolen prize items. If required by law, each winner will be issued a 1099 tax form for the prize value.

Publicity and Intellectual Property: Where permitted by law, by participating in the Sweepstakes, you grant OOSCA and those acting pursuant to their authority, the right to print, publish, broadcast, and use any materials (in whole or in part, or in edited form) you submit in connection with your entry or by membership in the OOSCA, it’s website and/or it’s social media sites, or the Sweepstakes, as well as your name, photo, likeness, voice, statements attributable to you (including comments and postings), city and state of residence, and other biographical information available to OOSCA, for advertising and promotional purposes throughout the world in any and all media now known or existing at any time in the future, without further approval, notification, or compensation.

Conduct: By entering the Sweepstakes and accepting a prize, the winner agrees to behave in accordance with all applicable laws and generally-accepted social practices in connection with participation in any Sweepstakes, Giveaway, or prize-related activity.  The winner understands and agrees that OOSCA has the right, in their respective sole discretion, to disqualify and remove the winner from any activity at any time if the winner’s behavior at any point (a) is uncooperative or disruptive; (b) annoys, threatens, or harasses any other person; (c) may or does cause damage to any person or property or OOSCA’s reputation; or (d) otherwise violates the policies of such prize provider; and, in such a case, the winner will forfeit all remaining elements of the prize and still be solely responsible for all taxes and other expenses related to the prize.

Release and Indemnification: By participating in this Sweepstakes, entrants agree: (a) to be bound by these official rules and the decisions of OOSCA and (b) to forever and irrevocably release, defend, indemnify, and hold harmless OOSCA and/or its affiliates, partners, members, directors, officers, employees, agents and successors (“Released Parties”) from and against any and all liability for claims, judgements, fines, costs, expenses, cause of action, including, but not limited to, personal injury, death or damage to or loss of property, in connection with or arising out of (i) the Sweepstakes, participation (or the inability to participate) in the Sweepstakes, or any element or activity thereof; (ii) any prize, including any liability or damage resulting from, arising from, or in connection with (1) cancellations, delays, diversions, or substitutions, or any other act or omission whatsoever; (2) travel to or from or participation in any prize-related activity; (3) lost, late, stolen, misdirected, damaged, or destroyed prizes; or (4) the acceptance, possession, use, or misuse of any prize, any defects in any prize, or any inability to use any prize and for claims based on publicity rights and intellectual property rights, defamation or invasion of privacy; or (iii) any errors in these official rules or any marketing materials in connection with the sweepstakes.

Limitations of Liability: The Released Parties are not responsible or liable in any way for: (1) any typographical or other errors in the typing, printing, the offering or the announcement of any prize or in the administration of the Sweepstakes; (2) any incorrect or inaccurate information, whether caused by entrants, typing and/or printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (3) technical, network, telephone, computer hardware or software malfunctions of any kind, including, but not limited to malfunctions, interruptions or disconnections in cellular networks, phone lines or network hardware or software failures of any kind including any injury or damage related to mobile devices or computers; (4) unauthorized human intervention in any part of the entry process or the Sweepstakes; (5) technical, human or other error which may occur in the administration of the Sweepstakes or the processing of entries; (6) incomplete, undecipherable, late, lost, undeliverable, damaged or stolen mail, misdirected or destroyed / mutilated entries, misdirected or faulty messages and/or submissions, any technical problems, entries not received during the Sweepstakes period for any reason, or other errors of any kind. Incomplete/illegible entries are void; (7) any error, omission, interruption, deletion, defect or delay in operation or transmission, theft or destruction or unauthorized access to or alteration of entries, or inaccurate transmission of, or failure to receive any entry information on account of technical problems or failures of any wireless or internet service providers, traffic congestion on the internet or at any web site or any combination thereof, which may limit a person’s ability to participate in the Sweepstakes or receive communications from OOSCA; and/or (8) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants’ participation in the Sweepstakes or receipt or use or misuse of any Prize. If for any reason an entrants’ entry is confirmed to have been erroneously deleted, lost or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes, if it is possible. If the Sweepstakes, or any part of it, is discontinued for any reason, OOSCA, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated prize will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated prize as set forth in these Official Rules to be available and/or claimed, OOSCA reserves the right to award only the stated prize by a random drawing among all legitimate, un-awarded, eligible prize claims. If, for any reason, the Sweepstakes is not capable of running as planned, OOSCA may, in its sole discretion, void any suspect entries and (1) cancel or terminate the Sweepstakes; (2) modify or suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; and/or (3) award the prize in accordance with the winner selection criteria set forth above from among all eligible, non-suspect entries received. OOSCA reserves the right, in its sole discretion, to disqualify any individual they find to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage any website or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil laws, and, should such an attempt be made, OOSCA reserves the right to seek damages from any such person to the fullest extent permitted by law. OOSCA’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. This Sweepstakes is intended for participation in the united states only and shall be construed only according to united states law.

Disputes / Governing Law: Except where prohibited, all entrants agree that: (1) any and all disputes, claims and causes of action arising out of or connected with the Sweepstakes or any Prize awarded shall be resolved individually, without resort to any form of lawsuit or class action, and be governed in all respects exclusively by the courts in the State of Illinois without regard to the conflicts of laws principles of any jurisdiction; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will entrants be permitted to obtain awards for, and entrants hereby waive all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above may not apply to you. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and OOSCA in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Illinois without giving effect to any choice of law or conflict of law rules (whether of the State of Illinois or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Illinois.

Disclaimer:  Released Parties are not responsible or liable for any typographical or other printing errors in the offer or administration of the Sweepstakes, including, but not limited to, errors in the printing or posting of the offer or these Official Rules, the selection or announcement of winners, or the distribution of any prizes. In the event that viruses, bugs, tampering, fraud, technical failures, unauthorized human intervention, acts of God, acts or regulations of any governmental or supra-national authority, war, national emergency, accident, fire, riot, strikes, lock-outs, industrial disputes, acts of terrorism, or any other matter beyond OOSCA’s reasonable control (each, an “Uncontrollable Event”) prevents, corrupts, or impairs the administration, security, fairness, or proper play of the Sweepstakes such that it cannot be conducted as originally planned, OOSCA reserves the right to cancel, terminate, or suspend the Sweepstakes at any time in its sole discretion, and none of the Promotion Parties shall be responsible or liable in any manner for such Uncontrollable Event or any such cancellation, termination or suspension. In the event an Uncontrollable Event occurs prior to the announced date for winner determination, OOSCA may determine the winner(s) by conducting a random drawing from among all eligible entries received up to such time of cancellation, termination, or suspension. In the event an Uncontrollable Event interrupts, interferes with, or disrupts the provision of any prize, OOSCA may substitute a prize of equal or greater value in its sole discretion.

Privacy / Opt-Out: Except as otherwise contemplated in these Official Rules, all personal information submitted to and collected by OOSCA in connection with the Sweepstakes will be used in accordance with OOSCA’s privacy policy, available at https://oosca.org/index.php/privacy-policy/ and these Official Rules. To “Opt Out” of the disclosure of any of your personal information by OOSCA or automatic Sweepstakes entry based upon membership in the OOSCA, e-mail us at: info@OOSCA.org, providing your name, address, and identification number (if any) and indicating your request to “Privacy Opt-Out”. If you are selected as a winner, your personal information may be included on a publicly-available Winner’s List.

Miscellaneous: OOSCA’s decisions are final and binding in all matters related to the Sweepstakes. The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. In the event that any provision of these Official Rules is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid, unenforceable, or illegal provision was not contained herein. OOSCA’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision. When terms such as “may” are used in these Official Rules, OOSCA has sole and absolute discretion. You agree to waive any rights to claim ambiguity of these Official Rules. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of any provision. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes-related materials and these Official Rules, these Official Rules shall prevail, govern, and control, and the discrepancy will be resolved in OOSCA’s sole and absolute discretion.
